OSHA Civil and Criminal Liability for Managers and Supervisors
Taught by an attorney with significant OSHA litigation experience, this course is designed for managers and supervisors who must understand the legal exposures they may have pursuant to the Occupational Safety and Health Act. This two and one-half day course includes the legal rights of the employer during an OSHA inspection; how to limit the scope of inspections; the right to refuse OSHA entrance; negotiating at settlement conferences and citation appeal process. Also covered are preparation and defense strategies, use of expert witnesses, workers compensation and civil liability, product liability and how to protect management against criminal liability.
Course highlights include classroom testimony and appeal reenactments, and the review of recent liability cases.
After completing this course participants should be able to:
- Understand their rights during an OSHA inspection
- Understand how the OSHA fine structure is calculated
- Negotiate for a fine reduction during a settlement conference
- Understand the different types of OSHA citations and the appeal process
- Defend themselves during an OSHA hearing
- Use expert witnesses for defense
- Protect against third party civil liability and criminal liability

- A detailed work manual. After the course, it becomes a valuable reference, with case law references to help implement skills learned during this course.
- Field Inspection Reference Manual (FIRM). The manual used by OSHA compliance officers for inspections.
- Copy of the OSH Act
- Certificate of Completion to serve as training documentation
